Your parents co-signed a car with you you are paying for your car everything that goes into that car Do your parents have any rights to take away the car If so how do you get the car put in your name?
Absolutely they do. The only way you have any right is to buy it yourself with no co signer. I know nobody likes to hear this, but if you need a co signer, THEY have a vested interest in how things go too. They actually stand to lose more than you if you mess up. Oh, and by the way, even if you DO buy the car all on your own other people can STILL take it away for what you may deem no good reason, i.e. Police officers, State officials, Loan officers, Collection agents. Your parents did you a favor by risking their credit to co sign on that vehicle. They can do pretty much anything they want as long as they feel it is in everyones best interest. You should be grateful that they did you that favor and HONOR their wishes by being more appreciative of them. LEGALLY, your parent can only do something if you do not make payments. Their only function in this case is to make the payments if you fail to. Even if this happens, they would have to go to court and show that you were not paying before they took the car. They accepted the risk of being a co-signer and it is a risk. This does not give them the right to take the car because you do something they do not like. They may have other "rights" if you are under 18 and still living with them, but you are the "owner" of the car. The lender, bank, credit union, whatever, only has a claim after you have failed to make the scheduled payments and a judge has said so.
It's a crime to take away someone's properties without consent. If you bought them yourself, they are yours and your parents have no right to take them.On the other hand, if you bought them with money your parents gave you, they aren't yours.
NO. Cosigning means the person is promising to be responsible for the debt if the primary borrower defaults.
When you sign a contract with your co purchaser and leased your car did he have the right to take the car back to the lot and get a full refund on the downpayment with out your knowledge or consent?
Technically yes, he probably did, but you are entitled to your part of the payment.
A child under 18 cannot legally own or take out a loan to purchase a vehicle.A parent must co-sign for the loan.
If the car has a primary owner and a co owner and the co-owner doesn't want to keep paying the monthly bill does the primary owner have the right to take the car away from him?
IF your name is on the TITLE, you have the right to possession. This is best done with lenders knowledge and/or assistance.
yes. parents are only required to provide you with food, water, shelter and one shirt, two shoes and one shirt.
Really genius? I work for a carrier and that's not true. If you're car is a 1997 why should we pay for new parts when your car was a POS before the accident? If your husband co-signs for his daughter's car loan will that affect you when you want to get a car loan?
No, not if the wife is the sole borrower.
If you have a car that everything is in your name but the loan says your the co-signer and now the buyers are making payments what are your rights and theirs to that car and can they take the car?
You are confusing me. If everything is in your name, how can you be the co-signer and not the primary borrower, and where did the "buyers" come in? Are you, perhaps 16-17 years old and your parents took away your driving privileges?
If the title is in the child's name, the child is the legal owner and the parent cannot take the car, regardless of who pays the insurance.
When you fail to make payments, they go after the co-signer. It can affect his credit. If he makes the payments he can take the car. You wouldn't want to make payments for someone else's car.
yes because you are still not a legal adult so you still have to abid by your parents rules.
If you have a car that's too expensive for you to pay for can you turn it in for a cheaper car without paying any penalties?
NO, there will be a penalty in some form all the time for bad decisions. It could be higher interest rates, bigger down payments, ect., but there will be a penalty.

From experience, yes, you do have the right to get your belongings out of the car. If your vehicle is being sold at a "Public" auction where anyone can go in and bid - then yes you can bid and/or buy your vehicle. Keep in mind that - if for instance - you owe $5000.00 and you buy your car back at auction for $3000.00 - you will still owe the lender the $2000.00 difference. In o...
Nope. Should have made the payments.
The co-signer will also have a repossession showing on their credit as well. The co-signer is just as legally responsible for the car as the person they signed for.
yes you do,the purpose of a co signer is that person is responsible for paying in the event that you dont pa,if that person is deceased you are still responsible.if you dont ,all non ppayments will go on your credit report
Do not panic. Get your foot out of the throttle. Loosen your grip on the steering wheel, but let your hands slide easily on the wheel. Im not a lawer but I think you committed a crime by not using your legal name. 2nd If you are the cosigner then you ultimately are responsible for the payments and your good credit rating. If you have a car loan can you switch that over to a different car and if so do you have to pay another downpayment and have your credit checked?
What are you planning on doing with the old car? Giving it back? The bank/lender won't take it back. Banks never do, and if it's a car dealership they will buy the car back from you at a very low price (i.e. black/bluebook price). I mean low compared to what you could sell the car for privately, ...
Once they repo the car, the lender will sell the car for whatever it will bring. You will then be responsible for the difference in what the car brings and the balance on the note. You may even be responsible for repossession fees, and your credit will be ruined for 7 years.

If you have to register your car with a salvage title do I have to get new license plates and pay for a dmv sticker that matches the new license plate?
The question shows a misunderstanding of what is required to register a vehicle with a salvage title.MOST places require a very detailed inspection the first time the car is registered after the title being "Branded" as salvage. After that the procedure is identical to all all other cars.
The vehicle will be sold at auction, the proceeds will be applied to the loan and to the repo fees, then you will still be responsible for any remaining amount owed to the loan.

Some states have different laws, but in Virginia, the deal is not finalized until you take possession of the car. It has to physically leave the car lot. Also, the bill of sale and contract have to correctly reflect the actual transaction. If you did not pay 4500 down, and the car lot is trying t...

Up to the lienholder but once you default they are entitled to the security and there are expenses involved as well to resell depending on who, amount, value of car and how far along they are in that process will decide it for them. Obviously they will cut their losses as much as they can.

Is there anything that you can do legally in Georgia to the person you co-signed for before the lender come after you when the car is repossessed?
Nothing that I know of, maybe a civil suit. You are learning the pitfalls of co-signing the hard way. Keep the lender aware of the signors address( so the lender can pester them as well as you), any windfall money the signor may get to collect from by the lender, ect. Good Luck
If you are in possession of the car then you are all set. if the car has been sold 3 or 4 time in other states and titles have been issued by other states it may get a little sticky.also if there is bankruptcy you may not be the legal owner of the vehicle. good luck

When a car gets repoed do they have to give you options to get your car back if so how many days do you have to take care of it in Texas?
Well, the repo company takes the repossessed vehicle to a storage lot or auction house, where it's stored for a period of time. Under state law, the repossessed vehicle must be sold in a "commercially reasonable" manner. You must be given reasonable notice of the date, time and place of the sale,...
Theoretically yes (though what the car is resold for is applied to the balance of the debt as a credit). However, lenders know their chances of getting that money are slim to none, because if you'd had the money you would have been making the car payments in the first place. So they tend to try t...

It depends which country you're in ! In the UK, you simply fill out the relevant part of the log-book - and send it to the DVLA. They enter the vehicle's details onto the DVLA national database as scrapped. If the car is subsequently seen on the road, the driver will have some serious questions t...

The lien holder from the previous owner needs to sign off on the sale before you can change the title. If you buy the car, but still owe money on it, you can get the title in your name with the previous owner as lienholder.
Unfortunately, no they won't. If you hand your car back before making the final payment (installment) on the loan the bank will class you as a bad debt.
